Oltre 150 parlamentari per la ripresa dei negoziati di pace, contro l’unilateralismo palestinese all’ONU

Sono oltre 150 i parlamentari italiani appartenenti a tutti i partiti politici che hanno firmato, su invito dell’Associazione parlamentare di amicizia Italia-Israele, un documento che chiede a tutto il consesso internazionale, all’ONU e ai Paesi Europei, di non procedere alla dichiarazione unilaterale di uno Stato Palestinese.

La lettera, promossa dal direttivo dell’associazione - i deputati Enrico Pianetta (Pdl), Fiamma Nirenstein (Pdl), Gianni Vernetti (Api) e la senatrice Rossana Boldi (Lega Nord) - invita a una più rapida ripresa dei colloqui di pace fra le due leadership, israeliana e palestinese, così da arrivare a una pace stipulata di comune accordo. Ogni unilateralismo, dice il documento dei parlamentari, viola la legalità internazionale e mette in discussione il principio della trattativa tra i popoli. Il preambolo stesso dello statuto delle Nazioni Unite afferma che l'Onu si impegna a “creare le condizioni in cui la giustizia e il rispetto degli obblighi derivanti dai trattati (…) possano essere mantenuti”.

La lettera firmata da 150 parlamentari chiarisce come l’unilateralismo metterebbe a repentaglio tutti gli sforzi internazionali per la pace affermati nelle risoluzioni 242, 338, 1850 del Consiglio di Sicurezza, nella Roadmap per la pace e in numerose prese di posizione del Quartetto e cancellerebbe di fatto tutti gli accordi già esistenti tra israeliani e palestinesi. Inoltre, se una dichiarazione unilaterale d’indipendenza dello Stato palestinese all’Assemblea Generale delle Nazioni Unite dovesse essere approvata, ciò costituirebbe un riconoscimento di Hamas, organizzazione terroristica fuorilegge nell’Unione Europea, Stati Uniti e Canada e oggi parte dell’esecutivo palestinese.

La raccolta procede e le firme saranno recapitate al Segretario Generale delle Nazioni Unite, Ban Ki Moon, prima dell’avvio dei lavori assembleari.

                        "Per il ritorno alle trattative, contro l’unilateralismo"

Noi, parlamentari italiani, riaffermiamo con forza il nostro impegno per una risoluzione pacifica e negoziata del conflitto tra israeliani e palestinesi, fondata sul principio di due Stati per due popoli che convivano l’uno accanto all’altro in pace e sicurezza. Una prematura dichiarazione unilaterale, invece, non solo minerebbe il processo di pace, ma costituirebbe un affronto permanente all’integrità delle Nazioni Unite, dei trattati esistenti e del diritto internazionale.

Crediamo che l’unilateralismo violi la legalità internazionale e metta in discussione il principio delle trattative tra i popoli.

Come evidenziato dal Presidente degli Stati Uniti, Barack Obama, nel suo discorso del 19 maggio 2011 al Dipartimento di Stato americano, una pace giusta e duratura è possibile solo attraverso un negoziato che implichi concessioni reciproche. “Le azioni simboliche per isolare Israele alle Nazioni Unite il prossimo settembre non creeranno nessuno Stato indipendente” ha dichiarato il Presidente. Lo stesso principio è stato riaffermato anche durante il G8 del 27 maggio 2011.

Una posizione simile è stata presa anche dal Presidente del Parlamento Europeo, Jerzy Buzek. Durante una conferenza stampa congiunta del 15 giugno 2011 a Ramallah con il primo ministro palestinese Salam Fayyad, Buzek ha dichiarato che il riconoscimento unilaterale di unilaterale di uno Stato palestinese sarebbe “pericoloso”.

Anche il governo Italiano ha dichiarato di essere impegnato a favorire la ripresa di un dialogo tra le due parti senza precondizioni e che l’Italia non è favorevole alla dichiarazione unilaterale. Si è espresso in tal senso anche il governo tedesco.

La posizione congiunta di America ed Europa nell’opporsi alla strada dell’unilateralismo palestinese, chiedendo al contempo negoziati diretti tra le parti, è motivata da alcuni principi cardine:

• L’unilateralismo metterebbe a repentaglio tutti gli sforzi internazionali per la pace affermati nelle risoluzioni del Consiglio di Sicurezza 242, 338 e 1850, nella Roadmap per la pace e in numerose prese di posizione del Quartetto; in ognuno di questi documenti si invoca una soluzione negoziata e accettata da entrambe le parti, rifiutando la via dell’unilateralismo. Come evidenziato dal Quartetto nel Febbraio 2011: “…azioni unilaterali da entrambe parti non possono pregiudicare il risultato dei negoziati e non saranno riconosciute dalla comunità internazionale”.

• Una dichiarazione unilaterale violerebbe gli accordi già esistenti tra israeliani e palestinesi, tra cui gli Accordi di Oslo II in cui si afferma che: “Nessuna parte può prendere iniziative che cambino lo status della Cisgiordania e della Striscia di Gaza in attesa del risultato dei Negoziati Permanenti” (articolo 31).

• Si facevano garanti dell’Accordo ad Interim tra israeliani e palestinesi, siglato da Israele e dall’OLP, le Nazioni Unite, l’Unione Europea, la Federazione Russia, gli Stati Uniti (ovvero il Quartetto), l’Egitto e la Norvegia. Sarebbe quindi altamente inappropriato per tutti questi garanti autorizzare una risoluzione delle Nazioni Unite che violi questo accordo, minando così le risoluzioni stesse del Consiglio di Sicurezza e del Quartetto.

• Se una dichiarazione unilaterale di indipendenza dello Stato palestinese all’Assemblea Generale delle Nazioni Unite dovesse essere approvata, ciò costituirebbe un riconoscimento di Hamas, oggi parte dell’esecutivo palestinese e tuttavia un’organizzazione terroristica fuorilegge nell’ Unione Europea, Stati Uniti e Canada. Tutto ciò mentre Hamas continua a opporsi ai principi base stabiliti dalla comunità internazionale: il riconoscimento del diritto di Israele a esistere, la rinuncia del terrorismo e il rispetto dei precedenti accordi internazionali.

L’Italia si deve dunque impegnare, oggi e nel futuro, per una soluzione negoziata del conflitto israelo-palestinese e si deve opporre al riconoscimento unilaterale di uno Stato Palestinese. Solo attraverso un immediato ritorno al tavolo dei negoziati, basato sul principio del reciproco riconoscimento, sarà possibile garantire una pace giusta e duratura.

150 Italian MPs against Palestinian unilateralism at the UN, for resumption of negotiations

Over 150 Italian MPs from all the political parties signed a document calling on the international community to oppose the resolution for a unilateral declaration of a Palestinian State to be presented at the United Nations General Assembly in September 2011.

The same letter has been presented in several States worldwide by the International Council of Jewish Parliamentarians, chaired by Italian MP Fiamma Nirenstein.

The document, launched in Italy by the board of the Italy-Israel Parliamentary Friendship Association – MPs Enrico Pianetta (Pdl), Fiamma Nirenstein (Pdl), Gianni Vernetti (Api) and Rossana Boldi (Lega Nord) – calls for a rapid resumption of negotiations between the Israeli and Palestinian leaderships, aimed at reaching a peace based on mutual agreement. “Unilateralism”, the document asserts, “violates international legality and harms the value of treaties among people”. The preamble of the UN Charter itself states that the UN is determined “to establish conditions under which justice and respect for the obligations arising from treaties (… ) can be maintained”.

The 150 MPs letter explains how unilateralism undermine all accepted international frameworks for peace such as UN Security Council resolutions 242, 338, and 1850; the Roadmap for Peace; and various Quartet statements and in fact it obliterates all the pre-existent agreement between Israelis and Palestinians. Moreover, if a unilateral recognition of a Palestinian State were to take place at the upcoming General Assembly, it will effectively constitute a recognition of Hamas, a terrorist organization outlawed in the European Union, the US and Canada and nowadays part of the Palestinian executive.

The collection of signatures is being updated daily and they will be delivered to UN Secretary General, Ban Ki-moon, before the opening of the next General Assembly session.

                  “For resumption of negotiations, against unilateralism”
 
We, members of the Italian Parliament, strongly reaffirm our commitment to a peaceful and negotiated resolution of the Israeli-Palestinian conflict based on the principle of two states for two peoples living side by side in peace and security. Indeed, a premature, unilateral declaration of Palestinian statehood would not only undermine rather than resolve the Israeli-Palestinian peace process, but would constitute a standing affront to the integrity of the United Nations, international agreements, and international law.

We believe that unilateralism will violate international legality and will harm the value of treaties among people.

As U.S. President Barack Obama put it in his speech of May 19, 2011 at the U.S. State Department, a just and lasting peace is possible only through a negotiated approach that involves mutual concessions. "Symbolic actions to isolate Israel at the United Nations in September won't create an independent state” stated the President, a position reaffirmed in the communiqué of the G8 of May 27, 2011.

A similar position was also taken by the President of the European Parliament, Jerzy Buzek. During a joint press conference with Palestinian Prime Minister Salam Fayyad on June 15, 2011 in Ramallah, Mr. Buzek declared that the unilateral recognition of a Palestinian state would be "dangerous".

Moreover these uniform American and European declarations opposing UN recognition of unilateral Palestinian statehood, while calling for direct negotiations between the parties, are anchored in a series of principles -- and related precedents -- including:

• First, it would undermine all accepted international frameworks for peace such as UN Security Council resolutions 242, 338, and 1850; the Roadmap for Peace; and various Quartet statements all of which call for a mutually negotiated and agreed upon resolution of the conflict while rejecting unilateralism. As the Quartet put it in February 2011 "... unilateral actions by either party cannot prejudge the outcome of negotiations and will not be recognized by the international community.”

• Second, it would violate existing Israeli-Palestinian bilateral agreements, most notably the Oslo II Agreements which state that “Neither side shall initiate or take any step that will change the status of the West Bank and the Gaza Strip pending the outcome of the Permanent Status negotiations" (Article 31).

• Third, while the Israeli-Palestinian Interim Agreement was signed by Israel and the PLO, it was witnessed by the UN together with the EU, the Russian Federation, the US, (i.e. the Quartet) and Egypt and Norway. It would be highly inappropriate, therefore, for such witnesses to now authorize a UN measure that would effectively violate this agreement while undermining major resolutions of the UN Security Council and the Quartet themselves.

• Fourth, it would unravel the institutionalized legal and administrative framework that underpins existing Israeli-Palestinian relations, which include bilateral arrangements in over forty spheres of civilian activity and which serve as a basis for economic, legal, and security cooperation and might well precipitate new and violent confrontations.

• Fifth, if such UN unilateral recognition were to take place while Hamas is the ongoing authority in Gaza, in partnership with Fatah, it would effectively constitute recognition of Hamas – a terrorist organization outlawed in Canada, the US, and European countries – while Hamas continues to reject the basic requirements of the international community such as recognizing Israel’s right to exist, forswearing terrorism and accepting previous international agreements.

• Sixth, and as a corollary, the Palestinian Authority does not meet the traditional test for statehood – particularly the test of effective government – such that a premature and unilateral recognition of an “unripe” Palestinian state could have a prejudicial effect on other regional conflicts.     

Accordingly, we ask that you reaffirm the commitment of Italy to a negotiated solution to the conflict and to oppose the unilateral recognition of a Palestinian state. Only an immediate return to negotiations based on the principle of mutual recognition will ensure the establishment of a just and lasting peace.
